1. Contracts
The contract is between NNZH and the client, being any person travelling
or intending to travel on a tour supplied by NNZH as either operator
or agent. The contract, including all matters arising from it, is
subject to New Zealand law and the exclusive jurisdiction of the
New Zealand Courts. Only employees and Directors of NNZH have authority
to vary or omit any of these terms.
2. How to Book:
To secure a booking, NNZH or their agent requires a completed Booking
Form, signed by the client or the parent or legal guardian if the
client is under 18 years, and the necessary deposit or full payment
if travel is within 65 days. A booking is accepted and becomes definite
from the date NNZH has confirmed acceptance in writing. NNZH or
their agents reserve the right to decline any booking at their discretion.
Where activities are stated 'option of' the client must state first
choice of activity at the time the Booking Form is completed.
3. Payment:
The balance of all monies due, including any surcharges must be
paid to NNZH no later than 65 days prior to departure. In the case
of non-payment of the balance by the due date NNZH may treat the
booking as cancelled by the client without any further communication.
4. Pre-departure Information:
On receipt of full payment Trip Supplement, giving full details
of what to bring, joining instructions and a detailed itinerary
will be forwarded.
5. Price Insert:
All departure dates, costs, gradings, itineraries, price inclusions
and group numbers are detailed in the Price Insert. Itineraries
have been edited, full itineraries are available on request. To
request, quote Dossier number quoted. BLD means breakfast, lunch,
dinner included in price.
6. Alterations & Amendments:
An administration fee of $50.00 per person, plus any additional
costs incurred will be charged if a confirmed booking is changed
or transferred prior to 65 days before departure.
7. Cancellations:
If cancellation occurs up to 60 days prior to departure a cancellation
cost up to but not more than the deposit will be incurred. If cancellation
occurs after 60 days prior to departure, the cancellation fee will
be based on costs incurred, including costs levied by other operators.
This is in addition to the deposit which will be forfeited. Copies
of all operator's cancellation fees are available on request. If
cancellation looks likely please contact NNZH immediately as a solution
may be found.
8. Complaints:
Should the client have a complaint about any of the tour arrangements,
the client must tell the relevant supplier at the time and inform
NNZH in writing. If the supplier and NNZH know about problems there
will be an opportunity to settle any grievance.
9. Children:
Child prices are stated for holidays most suited for children. Please
apply for a quotation if a child price is not quoted. Child prices
are based on at least one adult accompanying the child. Minimum
ages are applied to children and are adhered to for the safety and
comfort of the entire group.
9. Insurance:
NNZH recommends the client takes Cancellation Insurance. If the
client has to cancel for medical reasons, most cancellation charges,
less a small excess are covered by the policy recommended by NNZH.
10. Health and Fitness:
It is the client's responsibility to choose a trip within their
capabilities. As with most activities, the fitter the client is
prior to departure, the more enjoyable the trip will be. The majority
of NNZH trips only require clients to be in reasonably good health.
If clients have any doubts about their suitability for a particular
trip, they should contact their Doctor.
11. Holiday Participation:
Clients agree to accept the authority and decisions of NNZH and
their suppliers, employees, tour leaders and agents whilst on tour
with NNZH. If in the opinion of such person the health or conduct
of a client at any time before or after departure appears likely
to endanger the safe, comfortable, or happy progress of a tour,
the client may be excluded from all or part of the tour. In the
case of ill health, NNZH may make such arrangements as it sees fit
and recover the costs thereof from the client. If a client commits
an illegal act, the client may be excluded from the tour and the
company shall cease to have responsibility to or for them. The person
signing the Booking Form (which incorporates these terms and conditions)
warrants that he/she has full authority to do so on behalf of all
persons whose names appear thereon or separately in relation to
the group, and confirms that all persons are fully aware of and
accept these conditions.
12. Prices:
All prices are gross per adult unless otherwise stated. Single prices
mean room for exclusive use of one person. Share twin prices are
stated per person, sharing a room with one other. Triple share prices
are stated per person, with three sharing room. All prices include
New Zealand Goods and Services Tax of 12.5%.
13. Changes to Tours:
While NNZH will use its best endeavours to ensure all tours are
operated as advertised, reasonable changes in the itinerary may
be made where deemed necessary or advisable by NNZH. Changes will
be advised to the client as soon as reasonably possible. When a
major change is made the client shall have the choice of accepting
the change, purchasing an alternative tour or cancelling and receiving
a full refund. The definition of a major change will depend on the
individual tour and circumstances.
14. Weather:
Conditions on land, lakes and coastal waters, do from time to time
prevent the completion of advertised programmes. The decision is
normally made by the tour leader/captain at the time and is made
in the best interests of the group and their safety. NNZH and/or
their contracted suppliers can not be held responsible for these
changes.
15. Cancelled Tours:
NNZH reserves the right to cancel any tour in any circumstances.
Unless the client fails to pay the final balance, NNZH, upon cancellation
will return all monies paid or offer an alternative tour. NNZH is
not liable for any penalty charges associated with connecting air
fares, in the event of a change to a tour departure time, date or
cancellation.
16. Other Conditions:
NNZH as operator or agent finalises all arrangements for these tours
on the express condition that it shall not be held liable for any
injury, loss, accident, delay or irregularity which may be occasioned
either by reason of any defect in any vehicle, vessel or equipment
or by Acts of God or through the acts of default of any company
or person engaged in conveying the passengers or in carrying out
our arrangements of the tours or otherwise in connection herewith.
NNZH reserves the right to change any of the facilities, services
or prices described in the brochure.
NNZH accepts no liability for any action or activity undertaken
by the client arranged independently or NNZH while on tour. NNZH
shall not be liable to compensate clients for associated expenses
incurred as a result of their booking. No refund will be made for
any unused services which are included in the price.
